If you have been stopped for suspicion of DWI, the police officer may have asked you to take a breathalyzer test, in which you blow into a tube that purportedly gives the officer an accurate reading of your blood alcohol level. The results of the test are then admitted as evidence in criminal and administrative proceedings regarding the suspension of driving privileges and any penalties for violating driving laws.
You can challenge the validity of a breathalyzer test! The readings may be inaccurate or misleading for any of a number of reasons. The test may have been compromised by errors on the part of the police officer. You may have been using prescription drugs that combined with a legal amount of alcohol to give a false reading.

A breath alcohol test is normally conducted using a “breathalyzer,” a device that requires the police officer to observe the results on a needle. The officer must subjectively evaluate where the needle rests, particularly when it is near the legal level. If you are a diabetic or take prescribed medication for other conditions, such as ulcers, gall bladder problems or asthma, your medication can combine with any alcohol you have consumed to produce artificially inflated blood alcohol levels. Likewise, if you have recently vomited, any residue left in your mouth may have high concentrations of alcohol.
At Bailey & Galyen we have the experience to recognize all the circumstances that can lead to false or inaccurate breath alcohol tests. We will also carefully review police reports and question witnesses, if necessary, to verify that the tests were properly conducted.
We can help you challenge the results of a blood alcohol test. Contact our offices or call us anytime, 24 hours a day, seven days a week to schedule an appointment. Your first meeting is free of charge. Se habla Español.
